The book presents contemporary or emerging areas where alignment with notions of justice is not yet sufficiently established and so issues of equity and fairness need to be sorted out. It aims to clarify the issues of justice at stake, and highlight the facets of injustice at work that problematize our understandings and/or practices such as with generative AI, capital punishment, truth and reconciliation commissions, and Christian nationalism.

The edited volume brings together contemporary work by philosophers, legal scholars, and political theorists. The decision in Burwell v. Hobby Lobby Stores, Inc., suggested to many that the scope of religious liberty was in a principled, logical way expanded to include free expression rights of corporate entities. It is concerning that many champion the decision as a basis for expanding religious exemptions to non-discrimination law as regards public accommodations, especially since the same reasoning that is being used with respect to the contemporary target of discrimination based in religious belief—American citizens who happen to be (...) in a sexual minority—would apply by analogy, as it once did explicitly, to racial minorities. Unfortunately, given the rancor and the indefatigable ardor with which proponents insist on the rightfulness of their cause, we can lose sight of the trickiness that characterizes actual situations and the hurt experienced by individual persons who understand themselves to be uniquely positioned to be discriminated against when exercising their constitutional rights or engaged in ordinary activities in the public space, on the basis of someone else’s private religious beliefs. Looking back, I find the extension of exemptions on the basis of religious belief from neutral laws of general applicability inappropriate and to pose a threat to the equality of citizenship guaranteed by the 14th Amendment. In this paper our focus is not on discrimination against religion, but for it. We are concerned that U.S. citizens who are religious believers receive degrees of latitude and deference in the law relative to non-religious believers that privilege religion in general in American society to the detriment of the equal citizenship and standing of other citizens. In many cases, the citizens most impacted by religious deference are precisely those who have been identified in law and policy partly through the (...) lens of majority religious belief, as not deserving of equal consideration. This ought not be an effect of constitutionally securing religious freedom. We distinguish religion-based deference in law and policy with respect to race and sexual orientation to illustrate the conundrums we find, conundrums that are highlighted in the Supreme Court’s recent Hobby Lobby decision. Injustice itself is too infrequently the subject of direct rumination, with one notable exception being Judith Shklar’s The Faces of Injustice. The chapters in this volume consider some contemporary injustices, revealing their presence in ways that help to explain current issues that range from inequities in food access to the dangers of Christian nationalism, from better understanding how to conceptualize international law, to income disparity and the tax code.

Liberal Constitutionalism refers to a political regime governed by a constitution that establishes the rule of law, reflects liberal principles, and is supported by a society whose people can be said to reasonably understand and value those principles as well as the rule of law enshrined in it or in a well-settled understanding if unwritten. As society evolves, so too does its self-understanding of what those principles mean, and how its constitution should be interpreted so as to maintain its relevancy (...) and vibrancy. This evolution in self-understanding and constitutional interpretation guides the regime to enrich the ideals it stands for, such as equality before the law, individual liberty, democracy, tolerance of differences, and the like. Liberal constitutionalism, then, involves a reasonable concord, though not unanimity surrounding political organization and principles. The meanings and applications of documents and principles may be contested and change over time. Nevertheless, though disputes about the meaning and application of liberal principles are to be expected their resolutions are supposed to be amiable even when there is great diversity in the citizenry. Phillips & Silverstein's focus on schizophrenia as a failure of “cognitive coordination” is welcome. They note that a simple hypothesis of reduced Gamma synchronisation subserving impaired coordination does not fully account for recent observations. We suggest that schizophrenia reflects a dynamic compensation to a core deficit of coordination, expressed either as hyper- or hyposynchronisation, with neurotransmitter systems and arousal as modulatory mechanisms.

Throughout his relatively short life, Albert Camus struggled with nihilism and the absurd nature of human existence. Indeed, many of his writings deal with the problem of nihilism and with the issues of suicide, murder, suffering, and mass death. Always serious in his writings yet never resorting to cynicism or despair, Camus advocated rebellion as a response to nihilism. The choice of rebellion as a response to the absurdity of human existence makes sense when one realizes that his life (...) spanned the two world wars, the horrors of the concentration camps, and the repression of innocent civilians all over the world, from South America to Algeria. Despite the fact that they are in most respects environmentally benign, electricity-generating wind turbines frequently encounter a great deal of resistance. Much of this resistance is aesthetic in character; wind turbines somehow do not "fit" in the landscape. On one view, landscapes are beautiful to the extent that they are "scenic," well-balanced compositions. But wind turbines introduce a discordant note, they are out of "scale." On another view, landscapes are beautiful if their various elements form a stable and integrated organic (...) whole. But wind turbines are difficult to integrate into the biotic community; at least in certain respects, they are like "weeds." Moreover, there is a reason why the 100-meter, three bladed wind turbines now favored by the industry cannot very well be accommodated to any landscape view. They are, as Albert Borgmann would put it, characteristic of contemporary technology, distanced "devices" for the production of a commodity rather than "things" with which one can engage. It follows that the only way in which the aesthetic resistance to wind turbines can be overcome is to make them more "thing-like." One such "thing-like" turbine is discussed. (shrink)

Perhaps the gradualist position on abortion has re-emerged repeatedly because it corresponds to pastoral experienceAt one level David Albert Jones’s paper is very successful. Despite the high reputation of the late Gordon Dunstan, first as a mediaeval historian, then as an ethicist of considerable influence within the Anglican church, and finally as a pioneer medical ethicist, his crucial 1984 article appears to be overdrawn. Some caution is now needed before endorsing his claim that the Christian tradition according the (...) embryo the full moral status of a human person from conception is “virtually a creation of the later nineteenth century”. Dr Jones produces a wealth of historical scholarship to challenge it.At another level, however, Dr Jones is not concerned about nuancing a historical claim but about demonstrating that “licensing destructive research on human embryos for the sake of medical progress…cannot be justified…on the basis of the Christian tradition”.1 Unfortunately there is quite a large gap between these two claims. Manifestly “the Christian tradition” is not a unified tradition even within Jones’s own historical account. In recent years, marginalisation of women and third gender in mental health discourse has raised several issues vis-à-vis promised goals of holistic health for all as targeted by several national and international agencies (https://www.who.int/publications/i/item/WHO-MSD-MDP-00.1). Some attention is being paid to the perceived ‘gender gap’ that substantially enhances vulnerability of women and little explored third gender. Several research Studies (Albert, 2015; Pattyn, et al., 2015; https://www.news-medical.net/health/The-Gender-Gap-in-Mental-Health.aspx, accessed on 25th August 2024) have confirmed that this is no longer a perception as (...) the data confirms two to third fold more women experience depression and other related psychological and mental health issues vis-à-vis men. Social and cultural marginalisation plays a far more significant role in gendered discourse on mental health other than biological aetiology. Other problematic area where gender marginalisation is distinctively visible is in the institutional provisions for mental health care. This is a subject that has remained elusive and ambiguous in the texts of prescribed care for people suffering with intellectual disability, pejoratively spoken as ‘mental disorders’ in common parlance. Institutional confinement of the intellectually challenged in Asylums was started by the Arabs in Baghdad in the eighth century and later in Damascus and Aleppo in 1247 (Alexander and Selesnick, 1964). Inhuman imprisonment of people in these ‘total institutions’ (as described by Goffman, 1961) in the twenty-first century is a manifestation of abject indifference to our approach to psychological well-being. Goffman conceived these as anti-democratic institutions that inflict ‘negative experience of self’ (cf. Gordon and Williams 1977, p. 18). They add to a sense of alienation and isolation. Many would call these shelter homes as ‘social death knells’ (Finkelstein, 1991; Miller and Gwynne 1972). I do not have access to exact numbers but whatever data I am able to generate suggest that subjugation and exploitation of women and third gender in these institutions is far more than that of men. There are several questions that need immediate attention and thus forms the focus of this chapter that calls for a paradigm shift in the manner; mental health policy and institutional care are scripted in India. Lewis Gordon presents the first detailed existential phenomenological investigation of antiblack racism as a form of Sartrean bad faith. Bad faith, the attitude in which human beings attempt to evade freedom and responsibility, is treated as a constant possibility of human existence. Antiblack racism, the attitude and practice that involve the construction of black people as fundamentally inferior and subhuman, is examined as an effort to evade the responsibilities of a human and humane world. Gordon argues that the (...) concept of bad faith militates against any human science that is built upon a theory of human nature and as such offers an analysis of antiblack racism that stands as a challenge to our ordinary assumptions of what it means to be human. The Structure of Emotions argues that emotion concepts should have a much more important role in the social and behavioural sciences than they now enjoy, and shows that certain influential psychological theories of emotions overlook the explanatory power of our emotion concepts. Professor Gordon also outlines a new account of the nature of commonsense (or ‘folk’) psychology in general.

Challenging the notion of theory as white and experience as black, Lewis Gordon here offers a philosophical portrait of the thought and life of the Martinican-turned-Algerian revolutionary psychiatrist and philosopher Frantz Fanon as an example of "living thought" against the legacies of colonialism and racism, and thereby shows the continued relevance and importance of his ideas.

Readers of Theodor Adorno often have understood him as a "totalizing negativist." If it truly is the case that Adorno saw modern society as a realm of complete falsehood, however, his own social theory is unintelligible. In A Precarious Happiness, Peter E. Gordon aims to redeem Adorno from this negativist interpretation by showing that it arises from a basic misunderstanding of his work. Pushing against entrenched interpretations, Gordon argues that Adorno's philosophy is animated by a deep attachment to (...) a concept of happiness or human flourishing, and it is only by virtue of that normative standard that Adorno judges the world a catastrophic failure. Through a comprehensive reading of Adorno's work, A Precarious Happiness shows that in an imperfect world, the available standards of our flourishing are also imperfect. Looking beyond Adorno, Gordon suggests that the practice of social criticism, even if it is directed toward exposing what is "false," cannot succeed without appealing to an unrealized notion of what would be right. Might creolization offer political theory an approach that would better reflect the heterogeneity of political life? After all, it describes mixtures that were not supposed to have emerged in the plantation societies of the Caribbean but did so through their capacity to exemplify living culture, thought, and political practice. Similar processes continue today, when people who once were strangers find themselves unequal co-occupants of new political locations they both seek to call "home." Unlike multiculturalism, in which different cultures are thought (...) to co-exist relatively separately, creolization describes how people reinterpret themselves through interaction with one another. While indebted to comparative political theory, Gordon offers a critique of comparison by demonstrating the generative capacity of creolizing methodologies. She does so by bringing together the eighteenth-century revolutionary Swiss thinker Jean-Jacques Rousseau and the twentieth-century Martinican-born Algerian liberationist Frantz Fanon. While both provocatively challenged whether we can study the world in ways that do not duplicate the prejudices that sustain its inequalities, Fanon, she argues, outlined a vision of how to bring into being the democratically legitimate alternatives that Rousseau mainly imagined. Fanon's body of work serves as a critique of European science and society, and shows the ways in which the project of "truth" is compromised by Eurocentric artificially narrowed scope of humanity--a circumstance to which he refers as the (...) crisis of European Man. In his examination of the roots of this crisis, Gordon explores the problems of historical salvation and the dynamics of oppression, the motivation behind contemporary European obstruction of the advancement of a racially just world, the forms of anonymity that pervade racist theorizing and contribute to "seen invisibility," and the reasons behind the impossibility of a nonviolent transition from colonialism and neocolonialism to post colonialism. The eminent scholar Lewis R. Gordon offers a probing meditation on freedom, justice, and decolonization. What is there to be understood and done when it is evident that the search for justice, which dominates social and political philosophy of the North, is an insufficient approach for the achievements of dignity, freedom, liberation, and revolution? Gordon takes the reader on a journey as he interrogates a trail from colonized philosophy to re-imagining liberation and revolution to critical challenges raised by (...) Afropessimism, theodicy, and looming catastrophe. He offers not forecast and foreclosure but instead an urgent call for dignifying and urgent acts of political commitment. Such movements take the form of examining what philosophy means in Africana philosophy, liberation in decolonial thought, the unshackling of political philosophy from the liberal moral theory setting the stage for the decolonization of justice and normative life, unleashing the obstacles to cultivating emancipatory politics, challenging reductionist forms of thought that proffer harm and suffering as conditions of political appearance and the valorization of nonhuman being. He asserts instead emancipatory considerations for occluded forms of life and the irreplaceability of existence in the face of catastrophe and ruin, and he concludes, through a discussion with the Circassian philosopher and decolonial theorist, Madina Tlostanova, with the project of shifting the geography of reason. In this essay, Mordechai Gordon explores the significance of Rilke’s challenge to “live the questions” and embrace uncertainty with respect to the quest for certainty in education. The quest for certainty in education refers to our desire to gain a sense of psychological security and more control over a field that is fundamentally indeterminate. This quest implies an unwillingness to live with the inherent complexities and risks of education. After exploring the meaning and import of Rilke’s challenge and comparing (...) it to the position of Socrates, Gordon uses Rilke’s insight to analyze a specific educational experience and then discusses some of its educational implications for teacher education. From the beginning to the end of his career, the critical theorist and Frankfurt School philosopher Theodor W. Adorno sustained an uneasy but enduring bond with existentialism. His attitude overall was that of unsparing criticism, often verging on polemic. In Kierkegaard he saw an early paragon for the late flowering of bourgeois solipsism; in Heidegger an impresario for a "jargon of authenticity" that cloaked its idealism in an aura of pseudo-concreteness and neo-romantic kitsch; even in the more rationalist tradition of (...) Husserl's phenomenology he detected a vain attempt of the bourgeois spirit to break free from the prison-house of immanent consciousness. Yet his enduring fascination with the philosophical canons of existentialism and phenomenology suggests a connection far more complicated and productive than mere antipathy. From his first published book on Kierkegaard's aesthetic to the mature studies in negative dialectics, Adorno was forever returning to the philosophies of bourgeois interiority, seeking the paradoxical relation between their manifest failure and their hidden promise. Scholars of critical theory often regard these philosophical adventures as unfortunate lapses into reductive sociology or as marginal to Adorno's path of intellectual development.
